DECLARATION ON DATA PROTECTION

Effective April 18th, 2018

Qymatix Solutions GmbH appreciates your visit to our Website and your interest in our company, our products and our services. Protection of your privacy and personal data is a critical matter for us.

To ensure a high level of transparency and security, our declaration on data protection as set forth below will inform you as to the nature, scope and purpose of any collection, use and processing of information and data recorded by us. In this respect, please keep in mind that this declaration on data protection refers only to the publicly accessible Web sites with the following Internet addresses/URLs of Qymatix Solutions.

1. External Links

Our Website also refers to third parties. As a rule, we identify these by stating the relevant Internet address or the company/product logo. Qymatix has no influence whatsoever on the contents and design of sites of other providers and therefore cannot extend the warranties under this declaration on data protection to such sites. Nor does the fact that we refer to such sites mean that we adopt their contents as our own.

2. Cookies

A cookie is a small data text file stored on your computer or mobile device (if permitted by your browser) that Qymatix can retrieve to provide essential services while you are on our site. We do not use cookies to identify you or to retrieve your personal information.

Only the Qymatix website which set them can read the cookies. No other company or third-party has access to these cookies. A cookie cannot retrieve any other data from your hard drive or device, pass on a computer virus, or capture your email address or any additional personal information. You can set your browser to reject all cookies or to inform you before it stores them.

2.1 Session Cookies

Our Websites use so-called session cookies. These cookies deposit data for purposes of technical regulation in your browser’s memory. However, they do not contain any personal data, and your browser deletes them after your session has expired.

2.2 Mandatory Cookies

Qymatix Solutions GmbH deposits mandatory cookies on your computer, which are partly not deleted after finishing your session. Not removing these cookies makes it possible for the website to recognise your computer at your next visit and adapt the Qymatix’s site to your interests. These cookies do not store any personal information.

2.3 Website analytics

Our website uses Google Analytics. With this, we can analyse the utilisation of our website using cookies. From the collected data, we compile profiles using pseudonyms. We do not use the received data to identify the visitors.

3. Communication-related and Use-related Data

You visit Qymatix Website without us finding out who you are. Only for statistical and internal system-related purposes do we record the access time, the quantity of data transferred, the pages of ours that you visited, the page from which you accessed our Website and the browser that you use (log files), in addition to your IP address. To the extent that such information might enable conclusions concerning personal data, these are naturally subject to the relevant statutory data protection provisions.

3.1 Anti-Spam for Blogs

At the Blog of Qymatix Solutions GmbH, we use the Akismet anti-spam service, provided by Automattic, Inc., 132 Hawthorne Street, San Francisco, CA 94107, USA, to separate spam from regular user comments. Comment data will be sent to and processed by Akismet solely for this purpose. Akismet stores the data up to 4 days. In the case we rate the comment as spam, Akismet will store the data longer. The stored data includes name, e-mail address, IP-address, the text of the comment, the referrer, information about the used browser and computer systems and the time of the entry.

As an anti-spam provider, Akismet does not save the comment data permanently on its servers unless a comment was marked as false positive, in which case Akismet stores it long enough to use it to improve the service to avoid future false positives.

You may use a pseudonym for name and e-mail address. You can prevent the transmission of data to the USA as a whole if you do not use our comment system. That would be a pity, but unfortunately, we see no other alternatives that work as efficiently. For further information, please refer to Akismet’s Privacy Policy.

4. Collection of Personal Related Data

Since May 2018, Qymatix adheres to the General Data Protection Regulation (GDPR, also known as EU-GSDVO) in addition to the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG). We collect your professional contact data for business purposes only. The information that can be considered personal data according to EU GDPR Article 4(1), is your full name, shall you provide us with it.

To utilise the services offered on our Website, in particular, downloads, online forums, online applications, registrations for our courses or registrations for other services, it is necessary that we obtain this contact information from you. The contact data entails individual statements concerning personal and material relations about you, such as your name, your address or your e-mail address.

Such information is collected by us only if you provide it voluntarily and show us in this way that you agree to the use and processing thereof. We do not collect any personal private information such as your age, religion, marital status, personal address, location data, or factors specific to your physical, physiological, genetic, mental, economic, cultural or social identity.

5. Use and Processing of Personal Data

Qymatix Solutions GmbH process the contact data which we receive from our clients in the context only of our business relationship, for purposes of contractual settlement and handling your inquiries and requests.

Your professional contact data is processed and applied to a limited extent for customer management and marketing purposes, provided the relevant statutory provisions permit this. Should you no longer agree to such use, you may object to further use at any time, by the GDPR.

6. Forwarding of Data

Qymatix Solutions GmbH does business globally. To this extent, it might be necessary to forward your contact data to local distribution partners, whose registered office might also be located in countries outside the EU. However, such transmission takes place only within the group and solely for the business purposes mentioned above. Naturally, we do not forward your data to other third parties, unless we are obliged to do so by statutory provisions or judicial order. In particular, no personal data will never be sold or exchanged.

As a company based in Europe, Qymatix Solutions GmbH adheres at all times to the Directives of the General Data Protection Regulation on the protection of individuals concerning the processing of personal data and the free movement of such data.

7. E-mail Contact

Should you provide us with your e-mail address, we will also communicate with you by e-mail. Should you no longer desire such information, it is naturally possible for you at any time to revoke your consent. In this case, please send us a short message to the given postal or e-mail address. We will always use the email with which you contact us as your professional email and will use it only for the business purpose stated above, under the framework indicated in the General Data Protection Regulation.

8. Participation in Forums

We offer you the possibility of participating in online forums and commenting on our blog. To this end, we require sufficient information to be able to identify you so that, where applicable, we can meet our duty to determine the authors of illegal content subsequently. Your data is not disclosed to other forum participants unless you have consented to it in your user profile. Please keep in mind that the texts published by you may be viewed in part by everyone without limitation on the Internet. To this extent, please observe our Forum Guidelines or the Guidelines of any third provider we might use to this end (such as WordPress).

9. Data Protection for Minors

The offers on this Website are not intended for children. You must have attained legal age in your country to use our services.

10. Technical and Organizational Data Protection

We process the contact data mentioned above in compliance with the provisions of the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG).

Qymatix Solutions GmbH implements appropriate technical and organisational measures to ensure a level of security appropriate to the risk, including, but not limited to, the encryption of contact information, the ability to provide the ongoing confidentiality, integrity, availability and resilience of processing systems and services, the ability to restore the availability and access to your contact data in a timely manner in the event of a physical or technical incident, a process for regularly testing, assessing and evaluating the effectiveness of technical and organisational measures for ensuring the security of the processing.

11. E-Mails to Qymatix

Because of tax requirements, Qymatix Solutions GmbH has to archive e-mails for ten years in some countries. The e-mail system of Qymatix Solutions GmbH is intended to be used for business purposes.

12. Modification of the Declaration on Data Protection

As a result of the ongoing development of the Internet, it will be necessary to adjust this declaration on data protection to changing conditions on an ongoing basis. Timely notice of such modification shall be given on this page.

13. Procedural List

You may obtain a general overview of the purpose for which and the group of persons on which Qymatix Solutions GmbH collects, processes and uses personal data by sending us an email.

GDPR) and a right to data portability (article 20 GDPR).

Your right of access and your right to erasure are subject to the restrictions under sections 34 and 35 BDSG. You also have the right to complain to a supervisory authority (article 77 GDPR in conjunction with section 19 BDSG).

You may revoke your consent to the processing of your data at any time. This event also applies to the revocation of declarations of approval that granted before the entry into force of the EU General Data Protection Regulation, i. e., before 25 May 2018. Please be advised that the revocation will only take effect in the future.

15. Information and Other Rights, Contact

Upon written request, our data protection officer or employee responsible for her tasks would be happy to provide you with information as to whether – and if so, which – personal data we store about you. Should your data be incorrect, you may have this rectified immediately. Any such information or modification is free of charge.
